Privacy matters.
At MobyFly, we design and deliver 100% electric hydrofoil boats, and we know that data privacy is important to you. Here you'll find a short overview of how we handle your personal data, why we process it, and what your rights are. Each section links to a fuller explanation further down the page if you want more detail.
We are registered in Switzerland, with our head office in Valais, and operate various offices throughout other countries in Europe. We also work with partners and customers across Europe, so this policy is written to meet both the Swiss Federal Act on Data Protection (FADP) and, where it applies to us, the EU General Data Protection Regulation (GDPR).
1. Updates to this policy
We may update this policy periodically, for example, if we change how we use data or if the law changes. We'll update the date at the top of this page, so please check back from time to time.
2. What data do we collect?
We collect data depending on how you interact with us:
- Website visitors and enquiries: name, email, phone number, company name, and any message you send us. We also collect technical data such as your IP address, browser type, and the pages you visit.
- Newsletter subscribers: your name, email address, and marketing preferences.
- Customers and prospective customers: billing and delivery details, payment information, order history, and, if your boat has connected systems, usage data such as distance travelled, speed, and battery performance.
- Suppliers and business partners: business contact details, job title, and details of our dealings together.
- Cookies and similar technologies: when you visit our website. See section 8 for more.
Whenever we ask you for personal data, we'll make clear why we need it. If you choose not to provide it, this may limit what we can do for you. For example, if you don't give us a delivery address, we can't arrange delivery of your boat.
3. Different countries and legal entities
MobyFly operates across several European countries, and some of our activities may be carried out through different legal entities within the wider MobyFly group. Where this is the case, each entity remains responsible for the personal data it processes, but all entities follow the standards set out in this policy. If you're unsure which entity is responsible for your data, or you'd like more detail about a specific country's operations, please contact us at admin@mobyfly.com and we'll be happy to clarify.
4. Why do we process your data?
We process your data to answer your enquiries, send you marketing you've agreed to receive, fulfil orders and contracts, support and improve our boats, manage our customer relationships, and meet our legal obligations, such as accounting and tax rules.
5. Do we make automated decisions about you?
No. We don't carry out automated decision-making that produces legal effects for you or otherwise significantly affects you.
6. Who can access your data, and why?
We don't sell your personal data. We share it only with our service providers (such as our website, CRM, email marketing, and cookie consent platforms), our manufacturing partners when needed and where relevant to an order, marketing partners such as LinkedIn, and authorities where we're legally required to. If MobyFly is ever sold or merged, your data may be transferred to the new owner.
7. Social media
MobyFly has a presence on various social media platforms, including LinkedIn, Instagram, and YouTube. When you interact with us through these platforms, for example by following us, commenting, or sending us a message, that interaction is also governed by the terms of use and privacy policy of the platform itself, not just this policy. We'd encourage you to check the relevant platform's own privacy policy if you want to understand how they handle your data.
8. Do we transfer your data outside Switzerland or the EU?
Some of our service providers, such as Mailchimp, are based outside Switzerland and the EU/EEA. Where this happens, we put safeguards in place, such as Standard Contractual Causes or checking a provider is certified under the EU-US Data Privacy Framework.
9. How long do we keep your data?
We only keep your data for as long as needed. For example, enquiry data is kept for up to 48 months, newsletter data until you unsubscribe, and billing data for as long as Swiss law requires.
10. Cookies
Our website uses essential cookies to make it work, and, with your consent, analytics and marketing cookies to help us understand visitors and support marketing. You can manage your preferences through our cookie banner or your browser settings.
11. What are your rights?
You can ask us what data we hold about you, ask us to correct or delete it, ask us to limit how we use it, ask for it to be moved elsewhere, object to certain processing, and withdraw consent at any time. Contact us to make any of these requests.
12. Data security
We use reasonable technical and organisational measures to protect your data, including secure hosting, access controls, and working only with reputable service providers.
